@Eoghan_MomentFeed, it's a gray area. Since March Google has allowed certain modifiers for restaurants / food business. (See Google Allowing Restaurants Add Delivery Available Or Takeout Available To Business Name)

Google's also appears fine with modifiers like "curbside pickup," which I've seen in the wild.

The example you cite is not spam in my view, mainly because "patio available" isn't some big search term one might shoehorn into a GMB name for rankings purposes.

"PATIO AVAILABLE" is basically a COVID-19 modifier letting people know that they have an option for outside dining which may be safer.

From Google today:

"Unfortunately, that's not the case. Our partners and the community should continue to follow the guidelines. We suggest that you use business attributes to determine what services are available by the business in question. Changing the name of the business to reflect services offered is frowned upon and is definitely eligible for suspension. "
